Cross & Simon represents consumers and class action plaintiffs seeking damages and justice from companies and individuals who commit consumer fraud, breach duties of good faith and fair dealing with consumers, or manufacture dangerous or defective products.  Our firm will investigate and research claims of consumer fraud, with the goal of stopping and rectifying fraudulent consumer tactics, and discouraging future fraud.

Consumer fraud is often the deceptive or false statements made in the advertising, marketing and the sale of goods or services, including insurance. Some companies take illegal action to attract unsuspecting consumers. These actions may include:

      • selling defective or dangerous products
      • charging hidden fees
      • failing to provide insurance benefits
      • offering one product, but delivering another
      • false promises to obtain and promote patent and trademark rights
      • interpreting a contract or agreement or settling a claim in a way that unfairly disadvantages the customer

In December 2009, the United States District Court for the District of Delaware certified a consumer class action case filed by Cross & Simon, captioned, Johnson, et al. v. Government Employees Insurance Co., et al., D. Del. C.A.
